Overview

Filing a DMCA Takedown Notice

If you believe that content on ForexGroupBuy infringes your copyright, you may submit a DMCA takedown notice. To be valid, your notice must include:

Required Information:

1. Identification of the copyrighted work: Describe the work you claim has been infringed. If multiple works are involved, provide a representative list.
2. Identification of the infringing material: Provide the specific URL(s) or location(s) on ForexGroupBuy where the allegedly infringing material appears. Be as specific as possible.
3. Your contact information: Include your full name, mailing address, telephone number, and email address.
4. Good faith statement: Include the following statement: "I have a good faith belief that use of the copyrighted material described above is not authorized by the copyright owner, its agent, or the law."
5. Accuracy statement: Include the following statement: "I swear, under penalty of perjury, that the information in this notification is accurate and that I am the copyright owner or am authorized to act on behalf of the copyright owner."
6. Physical or electronic signature: Sign the notice (typed name is acceptable for email submissions).

Our Response to DMCA Notices

Upon receiving a valid DMCA notice, we will:

1. Review the notice for compliance with DMCA requirements (usually within 48-72 hours).
2. Remove or disable access to the allegedly infringing material if the notice is valid.
3. Notify the user who posted the content that it has been removed and provide a copy of the DMCA notice.
4. Document the claim for our records and repeat infringer tracking.

Note: We cannot provide legal advice or determine whether content is actually infringing. We rely on the accuracy of the statements made in DMCA notices. Filing a false DMCA notice may result in legal liability.

Filing a DMCA Counter-Notice

If you believe your content was removed in error or that you have the right to use the material, you may submit a DMCA counter-notice.

Required Information:

1. Identification of removed material: Describe the material that was removed and where it appeared before removal.
2. Your contact information: Full name, address, phone number, and email address.
3. Consent to jurisdiction: Include this statement: "I consent to the jurisdiction of the Federal District Court for the judicial district in which my address is located (or the Central District of California if my address is outside the United States), and I will accept service of process from the person who provided the DMCA notice or their agent."
4. Good faith statement: Include this statement: "I swear, under penalty of perjury, that I have a good faith belief that the material was removed or disabled as a result of mistake or misidentification."
5. Physical or electronic signature: Sign the counter-notice.

Our Response to Counter-Notices:

Upon receiving a valid counter-notice, we will:

1. Forward a copy of the counter-notice to the original complainant.
2. Inform the complainant that we will restore the removed content in 10-14 business days unless they file a court action seeking an injunction.
3. Restore the content if no court order is received within the specified timeframe.

Repeat Infringer Policy

ForexGroupBuy has a zero-tolerance policy for repeat copyright infringement. We will terminate the accounts of users who are the subject of multiple valid DMCA takedown notices.

Repeat infringer determination:

• First offense: Warning and content removal.
• Second offense: Temporary suspension (7-30 days) and content removal.
• Third offense: Permanent account termination and ban from the platform.

We reserve the right to terminate accounts after a single infringement if the violation is particularly egregious (e.g., commercial-scale piracy, malicious intent).

Fair Use Considerations

Not all uses of copyrighted material constitute infringement. The DMCA recognizes "fair use" under U.S. copyright law, which may include:

• Criticism, commentary, or review
• Educational purposes
• News reporting
• Transformative use

If you believe your use qualifies as fair use, include this information in your counter-notice. However, fair use determinations are complex and fact-specific. We cannot make legal judgments on fair use claims.

Misrepresentation & Penalties

Under the DMCA, anyone who knowingly misrepresents that material is infringing (or was removed/disabled by mistake) may be liable for damages, including costs and attorney fees.

Limitations of This Policy

This policy applies to copyright infringement claims under the DMCA. It does not cover:

• Trade secret misappropriation
• Privacy or defamation claims
